Client:
- Means any person for whom construction work is performed for;
- Party for who work is performed for. (It can be a person or an entity)
Construction Health and Safety Agent: (SACPCMP)
The person or entity appointed by the client through the Agent and who has full authority and obligation to act on the client’s behalf in terms of the Construct ion Regulations –
An agent contemplated in sub-regulations (5) and (6) must—manage the health and safety on a construction project for the client;
- and be registered with a statutory body approved by the Chief Inspector as qualified to perform the required functions;
Agent (Construction Health and Safety Agent)
Means a competent person who acts as a representative for a client;
Where a construction work permit is required as contemplated in regulation 3(1), the client must, without derogating from his or her health and safety responsibilities or liabilities, appoint a competent person in writing as an agent to act as his or her representative, and where such an appointment is made the duties that are imposed by these Regulations upon a client, apply as far as reasonably practicable to the agent so appointed.
Construction Work Permit
Regulation 3(1)
Client who intends to have construction work carried out, must at least 30 days before that work is to be carried out apply to the provincial director in writing for a construction work permit to perform construction work if the intended construction work will—

The said application must be submitted with the following documents:
- Health and Safety specification
- Health and Safety plan
- Baseline risk assessment
THE EXEMPTION (1)
A client who intends to have construction work carried out, must at least 30 days before that work is to be carried out apply to the provincial director in writing for a construction work permit to perform construction work if the intended construction work starts after the 7th of August 2015 and the works contract is of a value exceeding one hundred and thirty million rand or Construction Industry Development Board (CIDB) grading level 9.
THE EXEMPTION (2)
A client who intends to have construction work carried out, must at least 30 days before that work is to be carried out apply to the provincial director in writing for a construction work permit to perform construction work if the intended construction work starts on or after the 7th of February 2017 and the works contract is of a value exceeding forty million rand or Construction Industry Development Board (CIDB) grading level 8.
THE EXEMPTION (3)
A client who intends to have construction work carried out, must at least 30 days before that work is to be carried out apply to the provincial director in writing for a construction work permit to perform construction work if the intended construction work starts on or after the 7th August 2018 and – exceeds 365 days; will involve more than 3600 person days of construction work; or the works contract is of a value exceeding thirteen million rand or Construction Industry Development Board (CIDB) grading level 7.
